In today’s day and age a physical dental visit may not be an option for many people. Thank you for becoming a client of The Clear Guard. Our goal is your complete satisfaction. Please carefully read the following paragraphs. Your payment implies that you agree to our terms and conditions.

We are not examining your mouth. You understand that a doctor has not examined your mouth (oral cavity) to check for any physical anomalies or disease. We recommend that you have your oral cavity examined in person by Dentist or Physician at least once per year.

Our purpose is solely to make a new sleep apnea device, clear retainer, night guard, partial denture or to repair your existing device. By using our service, you agree that upon needing a sleep apnea device, clear retainer, night guard, partial denture or repair, it would not be REASONABLE to wait any longer and/or that a physical dental office visit would also not have been REASONABLE given your situation due to the inability to travel etc. 

Additionally, this was the fastest most convenient option you were able to find. If you did not use our service for the new sleep apnea device, clear retainer, night guard, partial denture or repair in the best/fastest/most convenient possible manner, more harm and discomfort (sleep apnea, eating, smiling, socially) would have been encountered than by not using our services. The Clear Guard is not a licensed provider of dental medicine in any state, and do not make any representations to the contrary. Notwithstanding the foregoing, The Clear Guard may engage the services of licensed dental providers in order to enhance the level of service provided to its users. Use of The Clear Guard does not substitute for your use of any licensed medical professional, including dentists, for medical and/or dental care.

What Can I Expect to Receive With My Order?

First Shipment – Dental Impression Kit

Your first shipment includes everything needed to make your dental impressions from the comfort of your home:

  • One (1) set of professional dental impression putty (blue and white)

  • Two (2) dental impression trays (multiple sizes may be included depending on your order)

  • One (1) prepaid USPS return shipping label to send your completed impressions back to our laboratory

  • Step-by-step written instructions

  • Access to detailed instructional videos and online resources demonstrating how to make accurate dental impressions

Shipping: We ship the impression kit directly to you, and we provide prepaid return shipping back to our laboratory at no additional charge.


Second Shipment – Your Custom Dental Appliance

Once your impressions have been received, approved, and your custom appliance has been manufactured, you will receive:

  • One (1) custom-fabricated dental appliance manufactured specifically for your dental impressions

  • One (1) ventilated protective storage case for safe storage when your appliance is not in use

Your custom appliance is individually handcrafted and quality inspected before shipment to ensure the highest level of fit, function, and craftsmanship.

If your order includes optional accessories or additional products, those items will also be included with your final shipment unless otherwise noted on your order confirmation.

After You Place Your Order

Once your order has been successfully placed, you will receive:

  • An order confirmation email.

  • Access to our detailed instructional videos and written guides explaining how to make your dental impressions.

  • A shipping confirmation email once your impression kit has been prepared for shipment and a USPS shipping label has been created.

Shipping of Your Impression Kit

Your impression kit is shipped from our Florida facility via USPS First-Class Mail.

Please allow approximately 2–5 business days for delivery after your order has been processed and shipped.

Returning Your Dental Impressions

A prepaid USPS return shipping label is included with your initial impression kit.

After dropping your completed impressions off with USPS, please allow approximately 2–5 business days for delivery to The Clear Guard laboratory.

Please Note: Replacement or remake impression kits do not include a prepaid return shipping label. Customers are responsible for shipping replacement impressions back to our laboratory using the carrier and service of their choice.

Order Processing

Orders generally require 1–3 business days for processing before shipment unless otherwise stated on the product page or during checkout.

Laboratory Production Times

Production begins after your impressions have been received, inspected, approved, and accepted by our laboratory.

All laboratory production times listed on our website are estimated manufacturing times only and do not include:

  • Order processing

  • Quality control inspection

  • Packaging

  • Shipping and handling

  • USPS transit time

Orders requiring remakes, additional information, new impressions, or quality control review may require additional processing time.

Final Shipment

Your completed custom dental appliance will be carefully packaged and shipped upon successful completion of manufacturing and quality inspection.

Sleep Apnea Appliances and EMA Devices are shipped via USPS with Signature Confirmation Required to help ensure secure delivery.

International Shipping

At this time, The Clear Guard ships within the United States only. We do not currently offer international shipping.

How Do the Clear Retainers and Night Guards Fit?

Every Clear Retainer and Night Guard is custom-made from the dental impressions you provide. The quality and depth of your impressions directly determine the fit, coverage, and retention of your finished appliance.

The Better Your Impression, the Better Your Appliance

For the best possible fit, your dental impression should capture each tooth completely—from the biting edge (incisal edge) all the way to the gum line.

If your impression captures the full height of every tooth, your finished appliance will also extend to the gum line, providing the best fit, retention, and durability.

If Your Impression Does Not Capture the Entire Tooth

Your custom appliance can only be manufactured from what is visible in your impression.

For example:

  • If your front teeth are fully captured to the gum line, your appliance will cover those teeth to the gum line.

  • If your back teeth are only partially captured, your appliance will only extend to the highest point shown in the impression.

Our technicians cannot manufacture material where no impression exists.

Common Impression Mistakes

A distorted impression may occur if:

  • The impression tray moves while the putty is setting.

  • The tray is removed and pushed back into the mouth.

  • The impression is not seated completely over the teeth.

  • Insufficient pressure is used to fully seat the tray.

  • Some teeth are not fully captured in the impression material.

Poor impressions may result in an appliance that does not fit properly or requires a new impression before manufacturing.

Taking a few extra minutes to create a high-quality impression greatly improves the final fit and helps avoid delays or the need for a remake impression kit.

If a new impression kit is required due to an unusable or distorted impression, replacement kits are available for $9.95 discounted from $19.95.


The 1.0 mm Clear Retainer is thinner and more flexible than the 1.5 mm version.

Benefits include:

  • Easier insertion and removal

  • Greater flexibility

  • More comfortable for many first-time retainer users

Because the material is thinner, our technicians are able to trim the retainer very precisely along your gum line.

The final trim line is determined entirely by the depth of your dental impression. The more of your teeth you capture, the more accurately your retainer can be trimmed for maximum coverage and retention.

For the best results, firmly seat the impression tray over all of your teeth to capture every tooth completely—from the biting surfaces to the gum line.Clear Retainer 1.5 mm

The 1.5 mm Clear Retainer is our thickest and most durable clear retainer.

Benefits include:

  • Greater strength and durability

  • Increased retention

  • Excellent for patients who prefer a tighter fit or require additional tooth support

Because the material is thicker and stiffer, the appliance may initially feel tighter than our standard retainer.

Do not force the appliance onto your teeth. If excessive force is required, discontinue use and contact us for assistance. Forcing a tight appliance onto the teeth may damage the appliance or your teeth.

Each 1.5 mm retainer is individually trimmed by our technicians based on your unique dental anatomy and impressions.


Every Appliance Is Truly Custom Made

No two mouths are exactly alike, and no two custom dental appliances are identical.

Each appliance is individually fabricated and hand-trimmed by our technicians based on your unique dental impressions. Small variations in trimming and appearance are normal and are part of the custom manufacturing process designed to provide the best possible fit for your individual smile.

Who Should Not Use a Sleep Apnea or EMA Device?

For your safety, Sleep Apnea and EMA (Elastic Mandibular Advancement) Devices are not appropriate for everyone.

Do NOT use these devices if you:

  • Are under 18 years of age.

  • Have been diagnosed with severe obstructive sleep apnea, unless specifically prescribed or approved by your physician or sleep specialist.

  • Have a history of temporomandibular joint disorder (TMJ/TMD) or significant jaw pain.

  • Have certain respiratory or breathing disorders that may make oral appliance therapy inappropriate.

  • Have loose teeth, untreated cavities, dental abscesses, severe gum disease, or advanced periodontal disease.

  • Wear full dentures, braces, or other dental appliances that prevent proper seating of the device.

  • Have dental implants, crowns, bridges, veneers, or other major dental restorations unless your dentist has determined the appliance is appropriate for you.

  • Do not have adequate natural teeth to securely retain the appliance.

Minimum Tooth Requirements

To properly retain a Sleep Apnea or EMA Device, you must have at least two (2) healthy molars on each side of the mouth, including:

  • Two (2) upper molars

  • Two (2) lower molars

These back teeth are necessary to help securely support and retain the appliance during sleep.

If you are unsure whether you are a candidate for one of our sleep apnea appliances, we strongly recommend consulting your dentist or physician before placing your order.


Can I Cancel My Order?

Orders may be canceled before manufacturing begins.

Because payment processing companies charge non-refundable transaction fees, all canceled orders are subject to a 5% credit card processing fee, which will be deducted from your refund.

Please note that all of our appliances are custom-made specifically for your dental impressions. Once manufacturing has begun, cancellation and refund eligibility are governed by our Refund Policy. Please review our Refund Policy for complete details regarding cancellations, partial refunds, and custom-manufactured products.

Due to hygiene standards and the health and safety of others, we do not re-use impression kits once they have been shipped.

What happens if the guard or clear retainer doesn't fit right?

While it's very rare, if it does happen, just email us to support@theclearguard.com. To be eligible for a refund, your item must be returned in the same condition that you received it, unworn, unused, with top and bottom dental stone models and in its original packaging. Adjustments are no charge and are covered under your product warranty with The Clear Guard. In the event the customer adjusts, modifies or damages the product, this voids all warranties and the product is non-refundable. 

Are Your Products BPA-Free?

Yes! Our Clear Retainers, Night Guards, and other applicable dental appliances are manufactured using FDA-cleared, BPA-free materials sourced from trusted professional dental suppliers in the United States.

Depending on the product you order, our appliances are also metal-free and acrylic-free where applicable. Please refer to the individual product description for specific material information.


What Are The Clear Guard Products Made Of?

The Clear Guard uses only high-quality materials designed specifically for professional dental appliance manufacturing.

Our products are fabricated using FDA-cleared, BPA-free dental materials purchased from reputable U.S. dental industry suppliers. These materials are selected for their durability, comfort, safety, and performance.

Every appliance is custom-manufactured specifically for your dental impressions and is quality inspected before shipment.

How Do I Take My Dental Impressions?

Taking your dental impressions is easy! Simply follow our step-by-step written instructions and instructional videos.

Our impression kits include professional dental impression trays and dental-grade putty, the same type of materials commonly used by dentists and orthodontists.

For the best results, carefully read all instructions before beginning and watch the videos in their entirety before mixing the impression material.


What If I Make a Mistake While Taking My Impressions?

Don't worry—mistakes happen, especially if it's your first time making dental impressions.

If you have any questions or are unsure whether your impressions are acceptable, please contact our Customer Support team before sending them back. We are happy to review photos of your impressions and help determine whether a new set is needed.

If a replacement impression kit is needed, existing customers may purchase one for the discounted price of $9.95 (plus applicable shipping and handling). The regular retail price of an impression kit is $19.95.

Our goal is to help you achieve the best possible impressions so your custom appliance fits comfortably and accurately.


Do Dentists Offer the Same Products as The Clear Guard?

Yes. Many dentists offer custom dental appliances similar to those manufactured by The Clear Guard.

We use professional dental materials and manufacturing techniques comparable to those used for dental professionals. Our dental impression trays and impression putty are professional-grade materials commonly used in dental and orthodontic offices.

Each appliance is custom fabricated from your dental impressions using high-quality dental materials and is individually inspected before shipment to help ensure quality, fit, and function.

What's Special About The Clear Guard Impression Material?

The Clear Guard uses professional dental-grade Polyvinyl Siloxane (PVS) impression material, the same type of material commonly used by dentists and orthodontists to create accurate dental impressions.

PVS is considered the industry standard because it provides:

  • Excellent accuracy and detail

  • Outstanding dimensional stability

  • Consistent, reliable results

  • Comfortable impression-taking experience

  • High-quality reproduction of your teeth and gums

Why Do Dental Impressions Sometimes Need to Be Remade?

Making dental impressions at home is simple, but like any new skill, mistakes can occasionally happen.

The most common reasons an impression may not be usable include:

  • The tray moved while the impression material was setting.

  • The tray was removed and reinserted into the mouth.

  • The tray was not fully seated over all of the teeth.

  • Not enough impression material was used to capture every tooth.

  • Some teeth or the gum line were not fully captured.

  • The impression was removed before the material had completely set.

To help you achieve the best possible results, we provide:

Taking a few extra minutes to review the instructions can greatly improve the accuracy of your impressions and help avoid delays or the need for a replacement impression kit.

You have 30 days after receiving your Clear Retainer or Night Guard to request a return / refund. In the event your Clear Retainer or Night Guard do not fit how you like, we will remake your product at no production charge. The product and stone models must be returned together prior to remaking the product. 

To be eligible for a refund, your item must be returned in the same condition that you received it, unworn, unused, with top and bottom dental stone models and in its original packaging. Adjustments are no charge and are covered under your product warranty with The Clear Guard. In the event the customer adjusts, modifies or damages the product, this voids all warranties and the product is non-refundable. 

Cancelled Orders:

5% credit card processing fee for cancelled orders.

Damages and issues:

Please inspect your order upon reception and contact us immediately if the item is defective, damaged or if you received the wrong item, so that we can evaluate the issue and make it right. When remaking a partial denture to change design and or color of the teeth, there is a 50% charge for the new partial denture. New dental impressions may be required.

Shipping Cost:

  1. Customer is responsible for paying shipping costs to return the items to The Clear Guard and such shipping costs will not be reimbursed.
  2. The Clear Guard will not bear any shipping cost to return the items to you in the following events: (a) USPS Returned To Sender; or (b) due to your failure to collect the items from the respective office of the shipping company.
  3. The Clear Guard is not responsible for products held at your local USPS.

The Clear Guard shall not be responsible for items lost or damaged in transit by the shipping company. You are advised to negotiate with the shipping company for any compensation entitlement for such loss. Once the product ships, the order is considered to be fulfilled. 

When returning your item, it is recommended to have tracking or delivery confirmation to ensure safe arrival, as items lost or damaged in shipping cannot be refunded.

Return Policy, Refunds & Non-Returnable Items

At The Clear Guard, every appliance is individually custom manufactured from your unique dental impressions or digital scans. Because our products are personalized medical devices that cannot be resold or reused, our return and refund policy differs from that of standard retail products.

By placing an order, you acknowledge that you have read and agree to this Return Policy.


Non-Returnable Items

The following products and services are non-refundable once purchased or performed:

  • Custom-manufactured dental appliances after production has begun

  • Super Rush and Rush Services

  • Digital Scan Services

  • Digital Model Storage

  • Teeth Model Printing

  • Shipping and handling charges

  • Accessories, including but not limited to:

    • Sleep Apnea Connectors

    • EMA Connectors

    • AM Aligners

    • I-Snore accessories

    • Replacement bands

  • Any other optional add-on purchased with an order


Custom Manufacturing

Each appliance is manufactured exclusively from the impressions, scans, photographs, or models provided by the customer.

Once your dental impressions or digital scans have been reviewed, approved, and accepted by our laboratory, your order enters custom manufacturing. At that point, a full refund is no longer available because the appliance is being individually fabricated specifically for you.

Because every appliance is custom made, it cannot be resold or reused for another customer.


Production & Shipping Times

All production times displayed on our website are estimated laboratory working times only and are not guaranteed.

Production estimates do not include:

  • Order processing

  • Quality control inspection

  • Packaging

  • Shipping and handling

  • USPS transit time

  • Delays caused by holidays, supply shortages, weather, or other unforeseen circumstances

Unexpected production delays may occasionally occur.

Super Rush and Rush Services receive priority handling within our laboratory but remain estimated production times and are not guaranteed.

Orders containing multiple custom appliances may require additional production time.


Dental Impressions

If our laboratory determines that your impressions cannot produce a quality appliance, we will notify you by email whenever reasonably possible.

We may provide photographs of your impressions along with an explanation of why new impressions are required.

Additional impression kits may be required before manufacturing can continue.


Dental Models

Customers may choose to have appliances manufactured from existing dental stone models.

When using customer-supplied models:

  • We guarantee the appliance will be manufactured to fit the models provided.

  • We cannot guarantee the appliance will fit in the mouth because we cannot verify the accuracy or age of the models.

  • Although we exercise great care during production, dental stone models are fragile and may occasionally chip, crack, or break during normal laboratory procedures.


Cancellation Policy

Orders may be cancelled before production begins.

Approved cancellations are subject to:

  • A 5% credit card processing fee, and

  • Applicable charges for impression kits, shipping, and handling when applicable.

Once production has begun, orders cannot be cancelled for a full refund.


Refund Policy

If an order is cancelled after manufacturing has begun but before shipment, a partial refund of 30% of the product purchase price may be issued.

Shipping charges, rush services, digital scanning, accessories, and other optional add-ons are not refundable.

After Delivery

If you decide not to keep your custom appliance:

  • Within 7 days of delivery, you may qualify for a 30% partial refund of the product purchase price.

  • Between 8 and 30 days after delivery, you may qualify for a 10% partial refund of the product purchase price.

  • No refunds are available after 30 days from the date of delivery.

To qualify for any eligible refund, returned products must comply with all applicable return requirements.


Partial Denture Returns

Flexible, acrylic, and clear partial dentures must be returned:

  • In the same condition as originally received.

  • Not worn beyond normal evaluation.

  • With the original upper and lower dental stone models included in the shipment.

Failure to return the models may reduce or eliminate any applicable refund.


Impression Kit Orders

If impression kits have already been shipped and the order is cancelled more than 30 days after delivery of the kits, a 70% cancellation fee applies due to the cost of materials, shipping, and processing.


Remakes

We stand behind our products and are committed to helping customers achieve a proper fit.

However, after multiple remakes, new impressions are generally required to improve accuracy.

If a third remake is requested:

  • New dental impressions will be required.

  • The remake charge will be 50% of the current product price.

For Sleep Apnea and EMA Appliances, remakes requested after the applicable adjustment period may be subject to a prorated remake fee of $149.00 per tray, depending on the circumstances.


Sleep Apnea & EMA Adjustment Period

It is normal for a new Sleep Apnea or EMA Appliance to require a short adjustment period.

Many customers experience temporary:

  • Tooth sensitivity

  • Jaw soreness

  • Gum tenderness

  • Mild muscle fatigue

These symptoms often improve after several nights of consistent wear.

We recommend allowing approximately five (5) consecutive nights for your mouth and jaw to adapt to the appliance.

If you experience severe pain, persistent discomfort, swelling, or symptoms that do not improve, discontinue use immediately and contact both your dentist and The Clear Guard.


Signature Required Delivery

All Sleep Apnea and EMA Appliances are shipped via USPS Signature Confirmation Required.

If delivery is refused or intentionally rejected by the recipient after the appliance has been custom manufactured, the order remains subject to this Return Policy.

Because the appliance has already been manufactured specifically for the customer, any applicable refund will be limited to a 30% partial refund of the product purchase price, excluding shipping, rush services, and optional add-on purchases.

1. Agreement to Terms

These Terms and Conditions ("Agreement") constitute a legally binding contract between The Clear Guard LLC ("The Clear Guard," "Company," "we," "our," or "us") and each purchaser, customer, user, or individual accessing our website or services ("Customer," "you," or "your").

By accessing our website, submitting an order, transmitting dental impressions, digital scans, photographs or other records, requesting products or services, making payment, or otherwise using any products or services offered by The Clear Guard, you acknowledge that you have read, understood, and agree to be legally bound by this Agreement, together with our Refund Policy, Warranty Policy, Privacy Policy, Shipping Policy, and all other policies published on our website, each of which is incorporated herein by reference.

If you do not agree to these Terms and Conditions, you must immediately discontinue use of our website and services.


2. Nature of Services

The Clear Guard is a private dental laboratory engaged in the manufacture, repair, replacement, modification, adjustment, and distribution of custom dental appliances, including, but not limited to:

  • Sleep apnea appliances;

  • EMA appliances;

  • Night guards;

  • Clear retainers;

  • Hawley retainers;

  • Acrylic and flexible partial dentures;

  • Orthodontic appliances; and

  • Related dental products and accessories.

Each appliance is individually manufactured using dental impressions, digital scans, photographs, prescriptions, or other information supplied by the Customer or the Customer's authorized dental provider.

Because each appliance is custom fabricated for a specific individual, it possesses little or no resale value once production has commenced.


3. No Practice of Dentistry or Medicine

The Clear Guard is not a dental practice, dental clinic, physician, medical provider, or healthcare provider.

The Company does not examine patients, diagnose disease, prescribe treatment, render dental or medical opinions, or practice dentistry or medicine.

Nothing contained within our website, products, marketing materials, customer communications, or support services shall be construed as dental, medical, or healthcare advice or as establishing a dentist-patient, physician-patient, or other healthcare provider relationship.

The Customer understands that use of The Clear Guard's products and services does not replace routine dental examinations, professional diagnosis, or treatment by a licensed healthcare provider.

The Clear Guard may utilize or consult licensed dentists, dental laboratories, or other qualified professionals in connection with manufacturing or customer support. Any such involvement does not alter the legal relationship established under this Agreement.


4. Customer Responsibilities

The Customer acknowledges and agrees that the Customer is solely responsible for:

  • Maintaining appropriate dental and medical care;

  • Obtaining professional evaluation whenever necessary;

  • Providing complete, accurate, and truthful information;

  • Submitting accurate impressions, digital scans, photographs, prescriptions, and other requested information;

  • Following all instructions provided by The Clear Guard regarding impressions, use, maintenance, cleaning, storage, and care of the appliance.

The Customer further acknowledges that inaccurate impressions, damaged impressions, distorted impressions, incomplete scans, inaccurate photographs, or incorrect information may adversely affect the fit, comfort, function, or appearance of the finished appliance and may require adjustments, remakes, replacement, or additional manufacturing charges.


5. Recommendation for Professional Dental Care

The Clear Guard strongly recommends that every Customer maintain regular examinations by a licensed dentist or physician in accordance with generally accepted standards of care.

Customers experiencing pain, swelling, infection, bleeding, loose teeth, significant bite changes, oral lesions, trauma, difficulty swallowing, difficulty breathing, or any other concerning symptoms should discontinue use of the appliance, when appropriate, and promptly seek evaluation by a licensed healthcare professional.


6. Limitations of Mail-Order Manufacturing

The Customer acknowledges that The Clear Guard manufactures appliances through a mail-order process utilizing customer-provided information.

Unlike an in-person clinical examination, The Clear Guard cannot independently evaluate the Customer's oral health, periodontal condition, occlusion, temporomandibular joint function, existing dental restorations, tooth mobility, pathology, or other clinical conditions that may affect appliance fabrication, fit, function, comfort, or suitability.

Accordingly, all products are manufactured in reliance upon the information supplied by the Customer or the Customer's authorized dental provider.


7. Product Fit and Adjustment

The Customer acknowledges that all custom dental appliances, regardless of whether manufactured through a traditional dental office or a mail-order laboratory, may require an adaptation period, adjustment, modification, remake, or replacement to achieve optimal comfort and function.

Minor pressure points, changes in bite sensation, temporary discomfort, or adjustments are common characteristics of custom dental appliances and do not, by themselves, indicate that the appliance is defective.


8. Customer Acknowledgments

The Customer voluntarily elects to purchase custom dental appliances manufactured through The Clear Guard's remote manufacturing process.

The Customer understands the limitations inherent in remote manufacturing and acknowledges that appliances are fabricated exclusively from the records and information submitted to The Clear Guard.

The Customer further acknowledges that no guarantee is made that an appliance will require no adjustment, modification, or remake.


9. Electronic Acceptance

The Customer agrees that submission of payment, electronic acceptance during checkout, acceptance of an invoice, submission of impressions or digital scans, or continued use of The Clear Guard's website, products, or services constitutes the Customer's electronic signature and legally binding acceptance of this Agreement pursuant to applicable federal and state laws governing electronic contracts and electronic signatures.

The electronic acceptance of this Agreement shall have the same legal force and effect as a handwritten signature.

Jurisdiction, Venue, and Governing Law

Governing Law

All purchases, transactions, communications, products, services, and disputes arising from or relating to any order placed with The Clear Guard shall be governed exclusively by the laws of the State of Florida, without regard to its conflict of law principles.

Exclusive Venue

The customer expressly agrees that any claim, dispute, lawsuit, chargeback recovery action, contract dispute, warranty claim, refund dispute, or other legal proceeding arising out of or relating to any purchase from The Clear Guard shall be brought exclusively in the state courts located in Miami-Dade County, Florida, or, where applicable, the appropriate court located nearest to The Clear Guard's principal place of business.

The customer knowingly and voluntarily consents to the personal jurisdiction of the Florida courts and waives any objection based upon lack of personal jurisdiction, improper venue, or forum non conveniens.

Consent to Florida Jurisdiction

By placing an order, the customer acknowledges that The Clear Guard manufactures custom dental appliances in Florida and expressly agrees that Florida is the appropriate and convenient forum for resolution of all disputes.

Chargebacks

Customers agree that they will first contact The Clear Guard and provide a reasonable opportunity to resolve any concerns before initiating a chargeback or payment dispute.

If a chargeback is filed after the customer has received a custom-made product and the product is not returned to The Clear Guard, the customer remains responsible for payment of the purchase price, court costs, allowable interest, collection costs, and any other remedies permitted by law.

Custom Products

All appliances are custom manufactured specifically for the individual customer using their dental impressions or digital scans. Because each appliance is personalized, it has no resale value once manufacturing begins.

If a customer receives a refund through a chargeback, bank dispute, or other payment reversal and retains the custom product, The Clear Guard reserves all rights to pursue recovery of the purchase price, damages, court costs, attorney's fees where authorized by law, and any other available legal remedies.

Pre-Suit Notice

Before filing any lawsuit, either party agrees to provide the other party with written notice describing the dispute and allow at least ten (10) business days to resolve the matter voluntarily.

Attorney's Fees and Costs

To the extent permitted by applicable law, the prevailing party in any action arising from these Terms shall be entitled to recover its reasonable court costs and attorney's fees.
